    3. If you, as a user, do not agree with any of these conditions, you must stop accessing this site.
  2. Ownership of the Site.
    1. In accordance with Law 34/2002, of July 11, and other applicable legislation, we inform you that this website www.tiwiworld.com is owned by the entity with the social name Fromtheworldwithlove and tax identification number "B86997194".

    1. Fromtheworldwithlove reserves the right to unilaterally modify, at any time and without prior notice to its users, the content, structure, operation, or access conditions of this site.
    2. However, site users are aware and accept that some of the information contained therein may be incorrect, incomplete, outdated, or contain typographical errors. Fromtheworldwithlove is not obligated to update the content of this site and will not be responsible for the lack of updating of the information.   9. Right of Exclusion and Partial Nullity.
    1. Fromtheworldwithlove reserves the right to cancel, delete, or disallow the use of all or some of the services of the website to any user without prior notice if, in its opinion, the user is misusing it in any way.
    2. If a competent court determines that any of the provisions contained in these legal conditions is unlawful or void, such provision will be excluded if legally required. The user expressly accepts that the remaining provisions not excluded will not be modified and will remain in full force.
  10. Applicable Law and Jurisdiction.
    1. This site is located and operated from Spain. All matters relating to this site are governed by Spanish law and are subject to the jurisdiction of the courts and tribunals of Spain, without the principles of conflict of laws being applicable. In cases where the user does not have the status of a consumer or has their domicile outside of Spain, Fromtheworldwithlove and the user will submit to the courts and tribunals of "My city," with express waiver of any other jurisdiction that may correspond to them.
    2. If the user decides to use or consult this site from outside of Spain, they must bear in mind that they do so on their own initiative and are responsible for complying with the relevant local laws.
  11. Duration and Revision.
    1. Although the legal relationship between Fromtheworldwithlove and the user, derived from access and use of the site, has an indefinite duration, it will be considered terminated when the company modifies these general conditions. When the company announces the modification of the general conditions, and the user accesses and uses the services and content of the site, a new legal relationship of an equally indefinite nature will be considered initiated between both parties.
    2. Without prejudice to the foregoing, the company Fromtheworldwithlove is authorized to suspend, interrupt, or unilaterally terminate, at any time and without the need for prior notice or just cause, the provision of any of the services it offers.
    3. Fromtheworldwithlove reserves the right to unilaterally and without prior notice revise these terms of use at any time. The revised conditions will come into effect as soon as they are published on this site. If the user regularly uses this site, they must review the conditions regularly and refrain from accessing the site if they do not accept any of the revised conditions.  

 

This contractual document will govern the General Terms and Conditions for the purchase of glasses and accessories (hereinafter, "Terms") through the website www.tiwiworld.com, owned by FROMTHEWORLDWITHLOVE, S.L., under the trade name TIWI, hereinafter referred to as PROVIDER, whose contact details are also listed in the Legal Notice of this website.


These Terms will remain published on the website for the USER to reproduce and save them as confirmation of the contract, and may be modified at any time by FROMTHEWORLDWITHLOVE, S.L. It is the USER's responsibility to read them periodically, as those in effect at the time the orders are placed will be applicable. FROMTHEWORLDWITHLOVE, S.L. will archive the electronic document in which the purchase is formalized and will make it available to the USER should they request it.


Contracts will not be subject to any formality except in cases expressly provided for in the Civil and Commercial Codes or this or other special laws.
Acceptance of this document implies that the USER:


  • Has read, understands, and comprehends what is stated herein.
    ● Is a person with sufficient capacity to contract.
    ● Assumes all obligations set forth herein.
    These terms will have an indefinite validity period and will apply to all contracts made through the PROVIDER's website.


The PROVIDER informs that the business is responsible for and aware of the legislation of the countries to which it ships products and reserves the right to unilaterally modify the terms without this affecting the goods or promotions that were acquired prior to the modification.

Identity of the contracting parties
On the one hand, the PROVIDER of glasses and accessories contracted by the USER is FROMTHEWORLDWITHLOVE, S.L., with registered office at AVDA. CAMINO DE LO CORTAO 28A, NAVE 3, 28703, SAN SEBASTIÁN DE LOS REYES, MADRID, NIF B86997194, and with customer service phone number 913554291.
And on the other hand, the USER, registered on the website using a username and password, over which they have full responsibility for use and custody, and is responsible for the accuracy of the personal data provided to the PROVIDER.

Purpose of the contract
The purpose of this contract is to regulate the contractual sales relationship created between the PROVIDER and the USER at the moment the USER checks the corresponding box during the online contracting process.
The contractual sales relationship entails the delivery, in exchange for a specific price publicly displayed on the website, of glasses and accessories.

Correction of data
When the USER identifies errors in the data published on the website or in the documents generated by the contractual relationship, they may notify this to info@tiwiworld.com so that FROMTHEWORLDWITHLOVE, S.L. can correct them as soon as possible.
The USER may keep their data updated by accessing their user account.

Contracting procedure
The USER, in order to access the products or services offered by the PROVIDER, must be of legal age or an emancipated minor and register on the website by creating a user account. For this reason, the USER must freely and voluntarily provide the personal data that will be required, which will be treated in accordance with the provisions of Regulation (EU) 2016/679, of April 27, 2016 (GDPR), regarding the protection of natural persons with respect to the processing of personal data and the free movement of such data, and Organic Law 3/2018, of December 5 (LOPDGDD), regarding the protection of personal data, as detailed in the Legal Notice and the Privacy Policy of this website.
The USER will select a password, committing to use it diligently and not making it available to third parties, as well as to notify the PROVIDER of its loss or theft or possible access by an unauthorized third party so that the PROVIDER can immediately block it.
Once the user account has been created, the USER is informed that, in compliance with the provisions of Article 27 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow the following steps:

  1. General contracting clauses.
  2. Sending and delivery of orders.
  3. Right of withdrawal.
  4. Claims and online dispute resolution.
  5. Force majeure.
  6. Competence.
  7. Generalities of the offer.
  8. Price and validity period of the offer.
  9. Transport costs.
  10. Payment method, charges, and discounts.

 GENERAL CONTRACT TERMS
Unless otherwise specifically agreed in writing, placing an order with the PROVIDER will imply the USER’s acceptance of these legal terms. Any stipulation made by the USER that differs from those of the PROVIDER must be expressly accepted in advance and in writing by the PROVIDER.

  1. SHIPPING AND DELIVERY OF ORDERS
    The PROVIDER will not ship any order until payment has been confirmed.
    Goods will typically be shipped using EXPRESS COURIER (SENDING, SEUR, DHL, etc.), according to the destination freely designated by the USER.
    The shipment will take place once the availability of the goods has been confirmed and the payment of the order has been verified.
    The delivery time will range between 2 and 7 business days, depending on the destination city and the chosen payment method. The expected shipping and delivery date will be provided prior to order confirmation.

Failure to execute the distance contract
If the contract cannot be executed because the contracted product or service is unavailable within the expected timeframe, the USER will be informed of the lack of availability and will be entitled to cancel the order and receive a full refund without any cost, and without liability for damages attributable to the PROVIDER.
The PROVIDER will not be liable if the delivery of the product or service cannot be completed due to false, inaccurate, or incomplete information provided by the USER.

Delivery will be considered completed when the carrier has made the products available to the USER and the USER, or their delegate, has signed the delivery receipt.

The PROVIDER will be responsible to the USER for any lack of conformity that exists at the time of delivery of the order. The USER may, with a simple declaration, require the PROVIDER to correct such lack of conformity, reduce the price, or terminate the contract. In any of these cases, the USER may also claim compensation for damages if applicable.

The USER has the right to withhold payment of any outstanding part of the price of the purchased product until the PROVIDER fulfills the obligations established in this contract.

It is the USER’s responsibility to verify the products upon receipt and note any justified exceptions or claims on the delivery receipt.

  1. RIGHT OF WITHDRAWAL

The USER has a period of fourteen calendar days, starting from the date of receipt of the product or from the date of conclusion of the sales contract in the case of a service, to exercise the right of withdrawal, as regulated by Article 102 of Royal Legislative Decree 1/2007, of November 16, approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, hereinafter RDL 1/2007.

If the PROVIDER does not comply with the duty of information and documentation regarding the right of withdrawal, the withdrawal period will end twelve months after the expiration of the initial withdrawal period, in accordance with Article 105 of RDL 1/2007.

The right of withdrawal will not apply to the contracts referred to and listed in Article 103 of RDL 1/2007, which are outlined here.

All returns must be communicated to the PROVIDER by requesting them through the form provided, indicating the relevant information requested in the form.

If the return is not made with the original delivery packaging, the PROVIDER may charge the USER for the cost associated with the product not being returned, informing them of this in advance through the same communication channel used.

Online Dispute Resolution (ODR)
In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the USER and the PROVIDER, without the need to resort to the courts, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will communicate with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the conflict.

  1. FORCE MAJEURE
    The parties will not be liable for any failure due to force majeure. Compliance with the obligation will be delayed until the cessation of the force majeure event.
  2. COMPETENCE
    The USER may not assign, transfer, or convey the rights, responsibilities, and obligations contracted in the sale.

If any provision of these terms is deemed null or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected in any way.

The USER declares that they have read, understood, and fully accepted these Terms and Conditions.

  1. GENERAL OFFER TERMS
    All sales and deliveries made by the PROVIDER will be subject to these Terms.

No modification, alteration, or agreement contrary to the Commercial Proposal of FROMTHEWORLDWITHLOVE, S.L. or these stipulated terms will be valid unless expressly agreed in writing by the PROVIDER. In this case, such specific agreements will prevail.

  1. PRICE AND OFFER VALIDITY PERIOD
    The prices indicated for each product or service include Value Added Tax (VAT) or other applicable taxes. Unless explicitly stated otherwise, these prices do not include shipping or communication costs, handling, or any additional and ancillary services to the purchased product.

Prices applicable to each product are those published on the website and are expressed in EURO. The USER acknowledges that the economic valuation of some products may vary in real-time.

Before making a purchase, all details of the budget can be reviewed online: items, quantities, price, availability, shipping costs, charges, discounts, taxes, and the total purchase amount. Prices may change daily until the order is placed.

Once the order is placed, prices will be maintained regardless of product availability.

All payments made to the PROVIDER will include an invoice issued in the name of the registered USER or the business name provided at the time of ordering. This invoice may be requested via email or through any of the means provided by the PROVIDER, and it may be revoked at any time.

  1. SHIPPING COSTS
    The prices published in the store do not include shipping or communication costs, installation or download services, or complementary services unless expressly agreed in writing.

Shipping costs will be calculated at the time of saving the cart or budget, as they are calculated based on product weight and delivery address.

  • Standard national shipping: 3 to 5 business days FREE.
  • SEUR national shipping: 2 to 3 business days (€3.95).
  • Express Europe shipping: 2 to 3 business days (€10.00).
  • Standard Europe shipping: 5 to 7 business days (€4.90).
  • Shipping to other countries: 5 to 7 business days (€6.00).

*Products shipped to the Canary Islands, Balearic Islands, Ceuta, Melilla, and the rest of the world are subject to a special tariff (THE CUSTOMER WILL COVER CUSTOMS COSTS, IF ANY), and shipping will be carried out via DHL EXPRESS.

  1. PAYMENT METHODS, CHARGES, AND DISCOUNTS
    The PROVIDER is responsible for economic transactions and enables the following payment methods:
  • Credit card
  • PayPal
  • Google Pay
  • Apple Pay

The USER may use a discount coupon before finalizing the purchase, provided it has been issued by the PROVIDER.

Security Measures
The website uses information security techniques commonly accepted in the industry, such as SSL, secure page data entry, firewalls, access control procedures, and cryptographic mechanisms, all aimed at preventing unauthorized access to data. To achieve these purposes, the user/client agrees that the PROVIDER may collect data for the corresponding access control authentication.

The PROVIDER commits to not allowing any transaction that is deemed illegal by credit card companies or the acquiring bank, and that could potentially harm or negatively impact their goodwill.

Under the credit card companies' programs, it is prohibited to sell or offer any product or service that does not comply with all applicable laws for the Buyer, Issuing Bank, Merchant, or Cardholder.

  1. PURCHASE PROCESS
    Any sunglasses or accessories from our catalog can be added to the cart. In the cart, only the items, quantity, price, and total amount will be displayed. Once the cart is saved, shipping costs and discounts will be calculated based on the payment and shipping information entered.

The carts are not legally binding; they only serve as a space to simulate a quote without any commitment from either party.

From the cart, an order can be placed by following these steps to correctly formalize it:

  1. Verification of email address.
  2. Verification of shipping and billing addresses.
  3. Selection of payment method.
  4. Place the order (purchase).

Once the order is processed, the system instantly sends a confirmation email to the USER's email address.

Orders (Purchase Requests)
Following the order confirmation, information will be provided about the order status and the approximate shipping and/or delivery date.

  1. SEVERABILITY AND SUSPENSION OR TERMINATION OF THE CONTRACT
    If any of these terms and conditions are found to be illegal, invalid, or unenforceable for any reason, that condition will be deemed severable and will not affect the validity and enforceability of the remaining conditions.

The PROVIDER may, without prior notice, suspend or terminate the USER’s access to its services, in whole or in part, if the USER fails to fulfill the obligations set out in this contract or any legal provision, license, regulation, directive, code of practice, or policies applicable to them.

When the PROVIDER exercises any of its rights or powers under this clause, such exercise will not prejudice or affect the exercise of any other right, power, or remedy that the PROVIDER may have.

  1. WARRANTIES AND RETURNS
    Warranties will comply with the regulations under the section "Warranties and After-Sales Services" of Royal Legislative Decree 1/2007 of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
  2. APPLICABLE LAW AND JURISDICTION
    These conditions will be governed or interpreted in accordance with Spanish legislation for matters not expressly established. Any dispute that may arise from the provision of the products or services covered by these Conditions will be submitted to the courts and tribunals of the USER's domicile, the place of performance of the obligation, or the location of the property if it is immovable.
